Florida Water Resource Implementation Rule
Section 62-40.431 – Stormwater Management Framework
Section 62-40.431 of the Florida Water Resource Implementation Rule, effective May 7, 2005, established the framework for statewide stormwater management. This rule defined the roles and responsibilities for FDEP and the Water Management Districts in coordinating Florida’s comprehensive stormwater program.
FDEP Role
Coordinates statewide program, establishes goals and guidance for Districts and local governments
District Authority
Chief administrators of state stormwater program with implementation responsibility
Performance Standards
80% reduction for standard waters, 95% for Outstanding Florida Waters
Coordination Structure: FDEP coordinates the program by establishing goals, objectives, and guidance, while the Water Management Districts serve as chief administrators. This collaborative approach ensures consistent statewide standards while allowing for regional implementation flexibility.
The framework maintained the core performance requirements from Chapter 62-25, requiring 80% reduction in pollutant loading for standard waters and 95% reduction for Outstanding Florida Waters. These standards would remain foundational as the state moved toward more comprehensive, nutrient-based criteria in subsequent rule revisions.
