New Statewide Stormwater Rule Implementation
Key Features and Timeline
Key Features of the New Rule
Maintenance Requirements
- Routine maintenance cost estimates
- Financial capability certification
- Consistent inspection requirements
Application Standards
- Criteria apply at project outfall
- Standardized across all districts
- Based on HUC-12 boundaries
Enhanced Flexibility
The new rule provides significant flexibility to permittees while maintaining rigorous environmental protection standards. Applicants can use existing or apply new site- or regional-specific Event Mean Concentrations (EMC), choose from innovative BMPs, and use off-site compensation to meet treatment performance standards.
Maintenance requirements now include establishment of routine maintenance cost estimates, certification of financial capability, and consistent inspection requirements based on the design of the stormwater treatment system. This ensures long-term system performance and environmental protection.
